Can someone sell an item to me, without having to make it a public auction, so that i still get the security benefits of buying on ebay, but without the auction process? The item is currently listed however a price is to be negotiated if it does not sell on ebay.

The auction process it now if you more than the auction the only downfall to cost you more than the auction the auction process it without the auction price.
